Lobbying the U.S Government is in compliance with the Lobbying Disclosure Act . Lobbying ostensibly serves a special purpose in terms of need / want representation with our Government.
The Lobbying Consulting Firm "Carmen Lobbying Group" - states the business or purpose of Lobbying as follows:
"We seek to affect policy and educate policy makers with arguments based on provable facts. We regard access as one of many key factors in the complex array of a lobbying campaign. We enjoy the access of experts with a reputation
for achieving results. "
As an arbitrary example one out of thousands of Lobbying entities, they represent clients who have a focus in affecting business within the U.S. Government and and related Policies in Defense
Education Healthcare Homeland Security International Trade Marketing Procurement Postal Transportation Water Resources & Environment .
In Judiciary Testimony, Thomas M. Susman, a partner in the law firm of Ropes Gray in Washington, D.C., when representing the American League of Lobbyists, stated his interest in improving the LDA process on behalf of the American People.
"Recent polls indicate that a majority of Americans do not trust lobbyists. The public often views the lobbyist as an unsavory figure, an "influence peddler" who secures for clients an unfair advantage in the inner-workings of government. The fear stems from the belief that lobbyists make secret deals with legislators to benefit special interests at the expense of the general welfare, or even that unsavory influences (in the forms of bribes, under-the-table deals, or coercion) have been brought to bear upon legislators, or that some groups are well represented in the lobbying process while others go substantially or completely unrepresented."
The Need for Full Public Disclosure of Lobbying Activities:
In a similar manner as a Tobacco Company stewards 'Anti-Smoking' initiatives, what was omitted was the need for full public disclosure of Lobbying activities when proposing Revision of the Lobbying Disclosure Act.
The following addresses revision of the LDA for the purposes of limiting misrepresentation and abuse of influence and providing:
- Transparency in Government Entity Association with Lobbyists
- Transparency in Lobbyist associations to Government Entities
- Transparency of Lobbyist Clients
Because of the Internet, the opportunity avails itself for Transparency in disclosure to the Public, about all relations that are directly related, or indirectly related between Lobbyists and Government Entity.
The Government can incorporate in the LDA a full disclosure public web site that documents the following information categories for a Registered Lobbyist where updates should be considered on periodic basis by the Registered Lobbyist:
- Clear Identification of Lobbyist: include Individuals, employees, consultants, members, partners , clients of, or otherwise that directly or indirectly represent a lobbyist entity by association are considered here as a Lobbyist.
- Related Lobbying Campaigns: that the Lobbyist represents as focus/purpose in the communication, socialization, or otherwise can be construed as a relationship, either casual, or active with a Government Entity must be considered related to a Campaign for/of in the affiliation of a Related Bill/Amendment; this is regardless if there is any monitory identification which can be associated, or even 0% Monitory association.
- Hence, a Lobbyist when associated with a Government Entity is related to all campaigns that are associated Lobbying Campaigns that are specific to the Government Entity.
- Related Government Bills/Amendments: Based on the Government Entity that is referenced by Senate / House Committee for the specific Bill/Amendment in question, that the Lobbyist Entity is associated with, the Lobbyist is considered to be associated with the Bill/Amendment in question.
- Related Government Entity/Contracts: that are associated with, or directly aligned with a department within the Government Entity that is provided as a Bid/Nobid Contract for services/products provided by a Non-Government Entity, that is based on budgets from a Bill/Amendment, is considered to be associated with the Lobbyist Entity that is associated with the Bill / Amendment in question.
- Related Government Entity/Representative(s):
including but not limited to Elected Official, Public Assigned Position,
or Government Organization are to be clearly indicated that are either
associated through 'Related Lobbying Campaigns; Bills/Amendments and
Committees that are associated with the Bill /Amendment in question; and
Government Entity/Contracts that are awarded that the Lobbyist Entity
is associated with.
- Contributions: including, but not limited
to ,Monitory gift, travel, promotion, soft dollar, or otherwise that are
provided either directly or indirectly to a Government Entity/Representative
from a Lobbyist, or indirectly from a lobbyist with respect to association
via a Lobbyist Client are to be clearly listed.
- Related Client Lists: Including the direct
client, ( and/or their intermediary, corporations, firms, partnerships,
organizations, ,subsidiaries or holding entities ) that is represented
by the Lobbyist Entity that is of direct or indirect benefit, or involved
in the Related Government/Entity Contract must be clearly identified as
a Client Entity of the Lobbyist Entity.
- Tax Statements: Current Filings of said
Lobbyist and Client Entities must be available by reference within the
LDA Registration.
- Sec Filings: Current Filings of
said Lobbyist and Client Entities must be available by reference within
the LDA Registration.
- Legal / Litigation Cases: Current
Filings of said Lobbyist and Client Entities must be available by reference
within the LDA Registration
- All Financial Audits: Current and
previous year Audit filings of said Lobbyist and Client Entities by reference within
the LDA Registration.
