About a Civilized Society
"MEN being, as has been said, by nature, all free, equal, and independent, no one can be put out of this estate, and subjected to the political power of another, without his own consent. The only way whereby any one divests himself of his natural liberty, and puts on the bonds of civil society, is by agreeing with other men to join and unite into a community for their comfortable, safe, and peaceable living one amongst another, in a secure enjoyment of their properties, and a greater security against any, that are not of it." John Locke (The Second Treatise of Civil Government, Chapter VIII Section 95) The Right and the Wrong of Law If it is not determined by a collective, I see that then in the wrong way, it is made to serve the few. Laws are supposed to serve the people as opposed to controlling them. This sometimes does not work. One example is prohibition. It was eventually repealed. As noted earlier, we can manage but we cannot control. As much as this applies to our children, this also applies to our society . Law makers collectively or individually also do not necessarily have an innate wisdom; besides who is to say that they seek a truth or even understand that it could be something that is only relative, and not necessarily absolute. On Retribution The punishment for breaking a law I think should also be reviewed. The Law might have validity, yet the punishment might not be legitimate. It could be very little, or arbitrary or overly harsh. As we evolve as a society, I hope that laws will be for only serving the people, and that punishments are for the purposes of rehabilitation, as opposed to being used as deterrents or revenge.
I am not saying one should have a 'get out of jail free card' when being a convicted felon, but incarceration with out anything else does not serve any one any good.
The Trickle Down of Laws Management As laws are to basically serve as a means of maintenance for our society, we also have to look at collateral influences in our social structure. In other words, why are we told that we must have such a low value of life in our media, I believe is due to feeding on diminishing returns.
For our children we can instill some sense of sanity, and for adults, laws that demonstrate reason. Justice may be blind, but its heart must see. This is my regard for the laws of our nation.
